These Terms of Service (“Terms”) govern your access to and use of the dogear service (“dogear,” the “Service,” “we,” “us”). By accessing or using the Service, or by clicking to accept, you agree to these Terms on behalf of yourself and the veterinary practice you represent (the “Clinic,” “you”). If you do not agree, do not use the Service.
1. What dogear is — and is not
dogear is a neutral technology platform that helps veterinary clinics request, transmit, and organize veterinary records with owner authorization. dogear is not a veterinary practice, does not provide veterinary or medical advice, does not practice veterinary medicine, and is not a party to the relationship between any clinic and its clients or patients. We are a conduit for information you and other clinics choose to exchange; we do not originate, verify, or endorse that information.
2. Eligibility
The Service is intended solely for licensed veterinary clinics and their authorized staff, used for legitimate professional purposes. It is not intended for consumers or pet owners (who interact only with a single-use authorization link). By using the Service you represent that you are authorized to bind your Clinic and to act on its behalf.
3. Your responsibilities
You are solely responsible, and dogear is not responsible, for:
- Authorization and consent. Obtaining and retaining all consents and authorizations legally required to request, release, or receive any records, from the pet owner and any other party, before using the Service to do so.
- What you upload and send. The accuracy, legality, completeness, and appropriateness of every document, request, and piece of information you submit, and confirming you have the right to submit it.
- Legal compliance. Your compliance with all applicable laws, regulations, and professional and confidentiality obligations, including state veterinary-records and client-confidentiality rules.
- Verification. Independently verifying any information received through the Service, including AI-generated summaries (see Section 4), against the source records before relying on it for any clinical, business, or other decision.
- Your account. Maintaining the confidentiality of your credentials and all activity under your account.
4. AI-generated summaries are an aid, not the record
The Service may use automated tools, including third-party artificial intelligence, to generate summaries of received documents. These summaries are provided as a convenience aid only. They are not veterinary advice, not a diagnosis, and not the medical record. They may be incomplete, inaccurate, or in error. The source documents are always retained and are the authoritative record. You must verify every summary against the source documents before relying on it. dogear makes no representation or warranty as to the accuracy, completeness, or fitness of any summary.
5. Pilot / early-access
The Service is provided on a pilot / early-access basis. It may change, be suspended, contain errors, be interrupted, or be discontinued at any time without notice, and data may be lost. You should not use the Service as your system of record or for any use where interruption or inaccuracy could cause harm, and you should maintain your own independent copies of all records.
6. No warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT ANY RESULTS FROM USE OF THE SERVICE OR ANY AI-GENERATED OUTPUT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOGEAR OR ITS OWNERS, OPERATORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY.
8. Indemnification
You will defend, indemnify, and hold harmless dogear and its owners, operators, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: your use of the Service; any content or information you submit; your failure to obtain any required consent or authorization; your violation of these Terms or of any law or third-party right; or any decision made in reliance on information or a summary obtained through the Service.
9. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Sections that by their nature should survive (including Sections 3, 4, 6, 7, 8, and 10) survive termination.
10. Governing law and disputes
